Q: What is a Phase I Environmental Site Assessment (ESA)?

A: Phase I ESA is a report intended to allow a user to satisfy one of the requirements to qualify for the innocent landowner defense of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA).

The Phase I ESA is completed to identify any recognized environmental conditions - meaning the presence of hazardous substances or petroleum products on a property.

A Phase I ESA is a process to identify recognized environmental conditions with four components 1.) Records Review, 2.) Site Reconnaissance, 3.) Interviews with owners, occupants and local government officials, and 4.) Evaluation and Report.

Q: Who requires Phase I ESA's?

A: Phase I ESA's are usually required by most Commercial Real Estate Companies, Prudent Investors and Commercial Lending Institutions to protect the parties should the Property be identified with environmental conditions. The importance of the Phase I ESA to the real estate agent is the due diligence completed to protect the agent's liability. If environmental contamination is found and a lawsuit is made, it could possibly include other interested parties - including Real Estate Agents, Brokers, and Environmental Companies.
